New Work Health and Safety Laws Stalled

On 29 November 2011, just one month before its anticipated commencement, the South Australian Parliament adjourned debate on the Work Health and Safety Bill 2010 (WHS).  As a result, the WHS reforms will not commence on 1 January 2012 as foreshadowed.

The WHS will be debated by Parliament early 2012. Therefore, we expect that South Australia will have a new occupational health and safety regime by mid 2012.

We recommend that all businesses utilise this extra time to prepare for the commencement of the WHS Act, Regulations and Codes of Practice.

Preparation should begin with all organisations familiarising themselves with the new regime, including the new Regulations and Codes of Practice, which will have force of law. It is vital to appreciate the structure in order to identify which parts of the new regime are relevant to your business, address any required changes and keep abreast of developments as they go.
